What is a Patent?

A patent is an exclusive right granted for an invention – a product or process that provides a new way of doing something, or offers a new technical solution to a problem. In exchange for full public disclosure of the invention, the patent owner receives the right to exclude others from making, using, selling, or importing the patented invention for the duration of the patent term.

In India, patents are governed by the Patents Act, 1970 (as amended). A patent is granted for 20 years from the filing date, subject to annual renewal fees. India is a signatory to the Patent Cooperation Treaty (PCT), enabling international patent protection through a single application process.

Requirements for Patentability

  • Novelty: The invention must be new and not disclosed anywhere in the world prior to the filing date
  • Inventive Step: The invention must not be obvious to a person skilled in the relevant field
  • Industrial Applicability: The invention must be capable of being made or used in some kind of industry
  • Not Excluded: The invention must not fall under the categories excluded from patentability under Indian law
